Insurance Cover for Recruitment Agencies

 

LIABILITY INSURANCE FOR RECRUITMENT AGENCIES

Public Liability (PL) insurance for recruitment agents will cover you in the event of a claim brought against your business for personal injury, or physical damage to third party property. The policy will cover both the defence of such claims, as well as any damages for which you are found liable.

Qdos are also able to include Employers’ Liability (EL) insurance in respect of your in-house staff.  Whilst our online product is not suitable for those firms who engage workers under contracts of employment (i.e. umbrella companies) or where the workers are not self-employed and/or under the supervision, direction or control of the end client, we are able to arrange cover on a bespoke basis.  Please click here for details.

In addition to Public Liability and Employers Liability, Qdos are able to add cover for Drivers’ Negligence to your policy. Where agencies provide HGV drivers, it is a common term of the supply contract that the agency remains liable for certain damage caused by the negligent act of the drivers. Our Driver’s Negligence policy protects against this exposure, and is available for up to 50 drivers (working at any one time) via our online application. Employers' Liability for Recruitment Firms

Employers’ Liability insurance is a legal requirement for any Limited Company employing one or more staff – this includes firms employing only their director, unless that director owns a minimum of 50% share capital. Further information can be found by consulting the Employers Liability (Compulsory Insurance) Act 1969.

Typically, the compulsory nature of Employers Liability insurance means that most firms will require a policy to cover at least their own in-house staff. In the recruitment sector, however, the ambiguity of employment status of workers may also dictate that Employers Liability also covers workers supplied by the firm. 

Where there is a contract of employment between the worker and the intermediary, as in a typically umbrella operation, an Employers Liability policy will remain a legal requirement. Whilst a potential claim may be mitigated or ultimately cover by the end client, the requirement for the umbrella firm to carry Employers Liability insurance would remain, even where the worker is under the supervision, direction and control of a third party.
